3. That the applicant'o property is Lot 2, Block 1 High Point Second <br />Addition and is located in the R-1 Residential District. <br />4. That the subject property is approximately nine acres in size. <br />5. That the applicant's request is to construct a 30' x 56' accessory <br />structure before the principal structure is constructed. <br />6. That the City Code states that no accessory structures maybe <br />constructed on a site until the principal structure has been <br />constructed on the site. <br />7. That there are no exceptional, unique or extraordinary circumstances <br />or conditions applying to the property in question as to the intended <br />use of the property that do not apply generally to other properties <br />in the same zoning district. <br />8. That such variance is not necessary for the preservation and - enjoyment <br />of a substantial property right similar to that possessed by other <br />properties in the same district and in the same vicinity. The <br />possibility of increased financial return shall not in itself be <br />deemed sufficient to warrant a variance. <br />9. That the authorization of such variance will not be of substantial <br />detriment to adjacent property and will materially impair the intent <br />or purpose of this ordinance or the public interest. <br />10. That the condition or situation of the subject property, or the <br />intended use of the property for which the variance is sought, is <br />of so general or recurrent a nature as to make reasonably practicable <br />the formulation of a general regulation for such conditions or <br />situation. <br />11. That the variance will not observe the spirit and intent of the <br />ordinance, ray produce substantial injustice and will be contrary to <br />the public interest. <br />12. That the size of the proposed structure is in excess of that permitted <br />by City Ordinance and has been shown no unique hardship which would <br />allow for the granting of a variance to the size. <br />Notion by Councilmember Reimann and seconded by Mayor Heitman to adopt Findings <br />' of Fact 0113, as amended, regarding Mr. Stanley Czech's request for a variance <br />to construct an accessory structure prior to the construction of the principal <br />structure. (Please refer to findings of fact file for Findings of Fact 0113). <br />Motion carried. Voting Yes: Chairperson Schlueter, Mayor Heitman, <br />Cbuncilmembers Sorteberg, Cox and Reimann.
