3. That the applicant'o property is Lot 2, Block 1 High Point Second Addition and is located in the R-1 Residential District. 4. That the subject property is approximately nine acres in size. 5. That the applicant's request is to construct a 30' x 56' accessory structure before the principal structure is constructed. 6. That the City Code states that no accessory structures maybe constructed on a site until the principal structure has been constructed on the site. 7. That there are no exceptional, unique or extraordinary circumstances or conditions applying to the property in question as to the intended use of the property that do not apply generally to other properties in the same zoning district. 8. That such variance is not necessary for the preservation and - enjoyment of a substantial property right similar to that possessed by other properties in the same district and in the same vicinity. The possibility of increased financial return shall not in itself be deemed sufficient to warrant a variance. 9. That the authorization of such variance will not be of substantial detriment to adjacent property and will materially impair the intent or purpose of this ordinance or the public interest. 10. That the condition or situation of the subject property, or the intended use of the property for which the variance is sought, is of so general or recurrent a nature as to make reasonably practicable the formulation of a general regulation for such conditions or situation. 11. That the variance will not observe the spirit and intent of the ordinance, ray produce substantial injustice and will be contrary to the public interest. 12. That the size of the proposed structure is in excess of that permitted by City Ordinance and has been shown no unique hardship which would allow for the granting of a variance to the size. Notion by Councilmember Reimann and seconded by Mayor Heitman to adopt Findings ' of Fact 0113, as amended, regarding Mr. Stanley Czech's request for a variance to construct an accessory structure prior to the construction of the principal structure. (Please refer to findings of fact file for Findings of Fact 0113). Motion carried. Voting Yes: Chairperson Schlueter, Mayor Heitman, Cbuncilmembers Sorteberg, Cox and Reimann. Voting No: None. Motion by Councilrember Reimann and seconded by Mayor Heitman to disapprove the request by Mr. Stanley Czech for a variance to construct an accessory structure prior to the construction of the principal structure based on the findings of fact.
