1 <br />I Notion carried. Voting Yes: Chairperson Schlueter, Mayor Heitman, <br />councilmemibers Sorteberg, Cox and Reimann. Voting Not None. <br />Mr. Czech suggested that the City inform future applicants that city ordinance <br />does not allow for construction of accessory buildings prior to the principal <br />structure; putting that 'stop sign' up save a lot of people a lot of time. <br />' Case #3: R=est For Variance 7b Oonstruct An Acoeasory StrairtnrP l Ar9cr <br />Than Allowed gym Code: CaQ? Of Mr. Steven John <br />Mr. Johnson was present and stated that his property is approximately 1 -1/2 <br />' acres in size, no second driveway would be required and the building would be <br />constructed of a covered galvanized material. Mr. Johnson stated that there <br />are buildings in his neighborhood of similar size and material type. Mr. <br />' Johnson stated that the building would be used to store personal vehicles and <br />would eliminate safety hazards to neighborhood children. Mr. Johnson stated <br />that he has received no negative comments from his neighbors regarding his <br />request; one neighbor was present tonight but had to leave; that neighbor has <br />no objections. Mr. Johnson stated that the building would be 200' from the <br />neighbor's property. <br />Councilmember Heimann noted that City Ordinance limits accessory building size <br />' to 624 square feet on parcels less than 2 -1/2 acres; it's Mr. Johnson's problem <br />if all his equipment won't fit into an accessory building of that size. <br />Mr. Johnson inquired it Councilmenber Reimann feels that it is better to have <br />unsafe items sitting in the open for children to get hurt on. Mr. Johnson <br />noted that a neighbor has a number of junk oars on his property that nobody <br />does anything about. <br />Mayor Heitman stated that the rules have been, are and will continue to be in <br />place; on the other hand, nobody shaved up to contest W. Johnson's request. <br />Councilmember Reimann stated that the ordinance was written to prevent <br />' accessory buildings that look out of place in relation to property size; the <br />ordinance was intended to make the City's job easier and Staff can inform <br />applicants that the Qty lives by and enforces the ordinance. <br />Mrs. Johnson stated that the size of building they are requesting does not look <br />out of proportion on their property. <br />Quuncilmember Schlueter referred to Item #2 of the proposed development <br />agreement regarding the accessory building structure being compatible with the <br />existing structure. <br />Mr. Berg stated that he has questioned Council before on this point and the <br />only answer he got from Council was that color should be compatible. <br />' Council amended the proposed findings of fact as follows: <br />' Change Item #4 to read as follows: 1 4that the subject property is less <br />than 2 -1/2 acres in size.' <br />July 23, 1985 <br />Page 5of7 <br />
