I <br />Motion by Mayor Heitman and seconded by Oouncilmember Sorteberg to adopt <br />' Findings of Fact 0114, as amended, for Mr. Steven Johnson's request for a <br />variance to construct an accessory structure larger than allowed ty City Code. <br />(Please refer to findings of fact file for Findings of Fact 0114). <br />' Chairperson Schlueter called for a roll call vote. <br />' Councilmenber Sorteberg - Aye <br />Wuncilmenber Cox - Aye <br />Mayor Heitman - Aye <br />Coincilmenber Reiman - Naye <br />Chairperson Schlueter - Aye <br />Motion carried. <br />' Motion by Mayor Heitman and seconded by CDuncilmember Sorteberg to approve Mr. <br />Steven Johnson's request for a variance to construct an accessory structure <br />larger than allowed by City code, contingent upon the applicant entering into a <br />development agreement with the City. Further, to add the following item to the <br />development agreement: 0 4hat the existing storage structure be removed from <br />the subject property.' <br />' Motion failed. Voting Yes: Mayor Heitman and Cotncilmenber Sorteberg. Rivers stated that he plans to convert the existing attached garage to <br />living space and is requesting a variance to construct a 1,008 square foot <br />attached garage. <br />Motion by Councilmember Cox and seconded by Mayor Heitman to adopt Findings of <br />Fact 0115 for Mr. James Rivers' request for a variance to construct an <br />' accessory structure larger than allowed by City Code. (Please refer to <br />findings of fact file for Findings of Fact 0115) . <br />' Further Discussion: Councilmember Reiman inquired if attached garages <br />exceeding a certain size are considered accessory. Mr. Berg stated that in th <br />past, Council has told him that they want to treat accessory structures <br />specificallly as the ordinance states; based on that, Mr. Berg has concluded <br />that accessory structures, even though attached, did not ocmply with the <br />ordinance and variances would be required. <br />' Motion carried. Voting Yes: Chairperson Schlueter, Mayor Heitman, <br />Councilmembers Sorteberg, Cox and Reiman.
