Mayor Heitman stated that he has more question he would like to ask. <br />Councilmember Cox replied that there is a motion on the floor. <br />chairperson Schlueter stated that all questions should be answered and directed <br />Mayor Heitman to continue. <br />Mayor Heitman stated that there other properties in the vicinity of Mr. Nieder <br />with accessory buildings, one in particular is of the pole barn type; inquired <br />if these other property owners went through the proper City procedure for <br />oversized accessory buildings. <br />City Attorney Goodrich stated that if the property owners went through the <br />proper procedure there would be a copy of their permit included in their <br />particular parcel file. <br />Mayor Heitman inquired as to how Council could deny Mr. Nieder's request, if <br />they chose to, if two of Mr. Nieder's neighbors were granted the same variance. <br />Councilmember Cox restated his motion. <br />Motion by Councilmember Cox and seconded by Councilmember Sorteberg to adopt <br />Findings of Fact 0118, amended to state building size of 30' x 34 for Mr. <br />Peter Nieder's Board of Adjustment variance. (Please refer to findings of fact <br />file for Findings of Fact 0118) . <br />Motion carried. Voting Yes: Chairperson Schlueter, Councilmembers Cox and <br />Sorteberg. Voting No: None. Abstain: Mayor Heitman. Absent: Councilmember <br />Reimann. <br />Councilmember Cox asked for an explanation of Mayor Heitman's vote to abstain. <br />Mayor Heitman stated that he has the prerogative to abstain. <br />' Councilmenber Cox stated that Mayor Heitman should be accountable. <br />Mayor Heitman replied that he is not accountable to Councilmember Cox. <br />Councilmember ODx stated that the Mayor is accountable to the citizens. <br />' Notion by Councilmember Cox and seconded by Councilmember Sorteberg to approve <br />Mr. Peter Nieder's request for a Board of Adjustment variance, contingent upon <br />Mr. Nieder's entering into a development agreement with the City of Ramsey. <br />' Further Discussion: Chairperson Schlueter inquired as to Cbuncilmenbers <br />Sorteberg's opinion in this case regarding placing buildings in a way that will <br />allow for future subdivision of the property. Mr. Nieder stated that his <br />' frontage is 95' and there is no way his parcel could ever be subdivided. <br />Chairperson inquired if Mr. Nieder is planning on accessing the accessory <br />building from 162nd. Mr. Nieder stated that he currently has a second access <br />' from 162nd that he has been using for the last 10 years. <br />Voting Yes: Councilmembers Sorteberg and Cox.
