All such faCilities, aisles and maneuvering space shall be surfaced in the same manner as that prescribed for parking areas. 5. Canplianoe: In order to assure compliance with the performance standards set forth above, the City Council may requi re the owner or opera tor of any permitted use to make such investigations and tests as may be required to show adherence to above per- formance standards. Such investigation and tests as are required to be made shall be carried out by an independent testing organization as may be agreed upon by the City and the owner or operator, or if there is failure to agree within ten days after written notice by the City to the owner or operator to JDake sud! investi- gation and tests, by such independent testing organiza- tion as may be selected by the Council. ihe costs in- curred in having such investigations or tests conducted shall be borne entirely by the owner or operator. !he procedure stated above shall not preclude the City frOlll taking any such other tests and investigations it finds appropriate to determine compliance with these performance standards. All costs incurred ~ the City in processing an application for a site plan review shall be paid by the applicant. Said costs shall include but not be limited to: professional consulting services as directed by the Planning Commission and/or City Council, coP.fing charges, extraordinary City staff involvement, public hearing publications, and written notice to adjacent property owners. A set fee established f rODl tilDe to time by the Ci ty Council shall be deposi ted wi th the Ci ty at the time the a:glUcation is made. At the time the application is made, if the ZOning Officer determines that costs in addi tion to the set fee will likely be incurred by the City, then an additional sum as determined by the Zoning Officer shall be deposited with the 9l
