, l70.0l3D CONDITIONAL OSE PERMI1S The purpose of this section is to provide the City of Ramsey with a reasonable degree of discretion in determining the suitability of certain designated uses upon the general welfare, public health, and safety. A conditional use is a use which because of certain characteristics cannot be properly classified as a permitted use in the zoning district within which it is proposed. Conditional use permi ts are designed to meet the problem which arises where certain uses, although generally compatible with the basic use classification of a particular zone, should not be permitted to be located as a matter of right in every area included within the zone because of hazards inherent in the use itself or special problems which its proposed location may represent. Applications for conditional uses shall be filed with the zoning officer and shall be acoexnpanied ~: a. An application fee in an amount equal to that set by resolution of the City Council, b. A site plan and supporting data whidl shows the size, location, and topograIilY of the site, the use of adjacent land, the proposed site, bulk, use, and location of buildings, the location and proposed function of all yards, o[:eIl spaces, parking areas, loading (where re- quired), storage areas, screening, fencing, signs, ac- cessory structures, the location of all utilities, and the timing of construction proposed. 'Ihe zoning officer shall forward copies of the application to the Planning CoIImission and City Council for review and awroval. The Planning Commission shall conduct a public hearing on the conditional use application and shall give at least 10 days mailed notice to property owners within 350 feet of the outer boundaries of the property in question. Ten days published notice in the official newpaper shall precede the hearing. Any person may awear and testify at the hearing ei ther in person or ~ duly authorized agent. ibe Planning Commission shall forward its findings on the application to the City Council within 30 days of the public hearing unless the petitioner agrees in wri ting to a time extension. 'Ihe City Council shall review the application and findings of the Planning Ocmmission and shall act upon said application within 30 days after receipt from the Planning Commission. If the Ci ty Council denies the application, that action shall be the City's final adninistrative action on the application. If the City Council approves the application, as a condition of that awroval, the Council may attach such condi tions as it deems necessary. All developnent, construction and use, shall be in acoordance with the awroved plan and conditions required by the City Council. Any developnent not in accord with the approved plan and oondi tions shall mnsti tute a violation of this chapter. 19 -
