<br />, <br /> <br /> <br />l70.0l3D CONDITIONAL OSE PERMI1S <br /> <br />The purpose of this section is to provide the City of <br />Ramsey with a reasonable degree of discretion in determining the <br />suitability of certain designated uses upon the general welfare, <br />public health, and safety. A conditional use is a use which <br />because of certain characteristics cannot be properly classified <br />as a permitted use in the zoning district within which it is <br />proposed. Conditional use permi ts are designed to meet the <br />problem which arises where certain uses, although generally <br />compatible with the basic use classification of a particular <br />zone, should not be permitted to be located as a matter of right <br />in every area included within the zone because of hazards <br />inherent in the use itself or special problems which its proposed <br />location may represent. <br /> <br />Applications for conditional uses shall be filed with the zoning <br />officer and shall be acoexnpanied ~: <br />a. An application fee in an amount equal to that set by <br />resolution of the City Council, <br />b. A site plan and supporting data whidl shows the size, <br />location, and topograIilY of the site, the use of adjacent <br />land, the proposed site, bulk, use, and location of <br />buildings, the location and proposed function of all <br />yards, o[:eIl spaces, parking areas, loading (where re- <br />quired), storage areas, screening, fencing, signs, ac- <br />cessory structures, the location of all utilities, and <br />the timing of construction proposed. <br /> <br />'Ihe zoning officer shall forward copies of the application to the <br />Planning CoIImission and City Council for review and awroval. <br /> <br />The Planning Commission shall conduct a public hearing on the <br />conditional use application and shall give at least 10 days <br />mailed notice to property owners within 350 feet of the outer <br />boundaries of the property in question. Ten days published <br />notice in the official newpaper shall precede the hearing. Any <br />person may awear and testify at the hearing ei ther in person or <br />~ duly authorized agent. ibe Planning Commission shall forward <br />its findings on the application to the City Council within 30 <br />days of the public hearing unless the petitioner agrees in <br />wri ting to a time extension. <br /> <br />'Ihe City Council shall review the application and findings of the <br />Planning Ocmmission and shall act upon said application within 30 <br />days after receipt from the Planning Commission. If the Ci ty <br />Council denies the application, that action shall be the City's <br />final adninistrative action on the application. <br /> <br />If the City Council approves the application, as a condition of <br />that awroval, the Council may attach such condi tions as it deems <br />necessary. All developnent, construction and use, shall be in <br />acoordance with the awroved plan and conditions required by the <br />City Council. Any developnent not in accord with the approved <br />plan and oondi tions shall mnsti tute a violation of this chapter. <br /> <br />19 <br /> <br />- <br />
