<br />" <br /> <br />, <br /> <br />170.013J BCNlD OF AIlJOSDlENT <br /> <br />'lhe Board of Adjusbnent shall consist of the seven Planning <br />Commission members. All appointees shall hold their position <br />until their successors are appointed and qualified. All members <br />shall serve without compensation. Board of Adjusbnent members <br />may be reimbursed for their necessary expenses incurred as a <br />result of serving on the Board. <br /> <br />'!he Board of Adjusbnent shall elect a chairJllan from among its <br />appointed members for a term of one year, and the Board may <br />create and fill such other offices as it may determine. The <br />Board shall hold meetings, keep minutes and, pursuant to notice, <br />shall conduct hearings, take testimony under oath, and render <br />decisions in writing within 4S days after the hearing or <br />continued hearing. A fee shall be charged in accordance with a <br />schedule annually affixed by City Council resolution for any <br />aweal or proceeding filed with the Board of Adjusbnent. <br /> <br />'Ihe Board of Adjusbnent shall have the power to hear and decide <br />aweals from ~ order, requirement, decision, grant, or refusal <br />made by the zoning officer in the administration of this <br />chapter. An appeal shall be in writing and filed in duplicate <br />with the zoning officer. Within 10 days after filing of the <br />appeal, the zoning officer shall transmit to the Board of <br />Adjusb'Dent all pipers involved in the proceedings. Upon receipt <br />of this material, the Board of Adjusbnent shall set a hearing <br />date and give notice by mail of the time, place and purpose <br />thereof to the appellant and to the zoning officer. ibe Board of <br />Adjusbnent may reverse or affirm wholly or in part any ruling, <br />decision, or determination of the zoning officer and may issue or <br />direct the issuance of a permi t. The decision of the Board of <br />Adjustment is final and may be appealed to the District Court. <br /> <br />170.0l3K ENFORCEMENT/PENALTIES <br /> <br />Any violation of this chapter may be enjoined by the City <br />Council through proper legal channels. Each day a violation is <br />permitted to exist shall constitute a separate offense. <br /> <br />In case any building, structure, or land is proposed to be <br />erected, reconstructed, altered, converted, maintained or used <br />in violation of this chapter, the City Council, in addition to <br />other remedies, may institute in the name of the City of Ramsey <br />any appropriate action or proceeding to prevent, restrain, <br />correct or abate such building, structure, or land, or to <br />prevent, in or about such premises, any act, conduct, business, <br />or use consti tuting a violation. <br /> <br />24 <br /> <br /> <br />- <br />
