'. , determination, the Board of Adjustment shall hold a public hearing thereon, and shall hear such persons as wish to be heard, ei ther in person or by agent or attorney. Notice of such hearing shall be published in a newsp!lper of general ci rculation at least 10 days prior to the date of the hearing. In addition, notice of such hearing shall be mailed not less than 10 days before the date of hearing to the person or persons who filed the appeal or request, and in the case of a request for a variance, to each owner of property situated wholly or partly within 350 feet of the property to which the variance relates. A map containing the names and addresses of property owners within 350 feet of the property whereon the variance is requested shall be submi tted with, and made a part of, the application for variance. Within a reasonable time after the hearing, the Board of Adjustment shall make its order deciding the matter and serve a cop.{ of such order upon the appellant or the peti tioner by mail. This shall be the final action of the City on the variance application. All costs incurred by the City in processing an application for a variance shall be paid by the applicant. Said costs shall include but not be limited to: professional consulting services as directed by the Planning Commission, Board of Adjustment, and/or Ci ty Council, coF,iing charges, extraordinary Ci ty staff involvement, public hearing publications, and written notice to adjacent property owners. A set fee established from time to time by the City Council shall be deposited with the City at the time the application is made. At the time the application is made, if the Zoning Officer determines that costs in addi tion to the set fee will likely be incurred by the City, then an additional sum as determined by the Zoning Officer shall be deposited with the City. Any portion of those funds deposited but not expended shall be returned to the applicant after final action on the application. 23 -
