<br />" <br /> <br />, <br /> <br />170.0131 VARIANCES <br /> <br />'Ihe p.1rpose of this section is to provide the Ci ty of Ramsey with <br />an opportunity for relief from unnecessary hardships resulting <br />from the rigid enforcement of its broad zoning ordinance. This <br />variance provision authorizes the Board of Adjustment to permit a <br />particular property to be used in a manner forbidden by the <br />dlapter by varying the terms of the chapter. <br /> <br />The Board of Adjustment, upon appeal of the zoning officer's <br />decision, shall have the power to authorize variances from <br />certain requirements of this chapter. Variances shall pertain <br />only to the Plysical characteristics of the land or structures to <br />be built thereon, such as area, height, extent of lot coverage, <br />setback requirements, and parking requirements. Specifically, <br />the Board of Adjusbnent may grant only non-use or area variances <br />and may not grant use variances. ~ <br /> <br />No variance in the provisions or requirements of this chapter <br />Shall be authorized by the Board of Adjustment unless it finds <br />evidence that all the following facts and conditions exist: <br />a. That there are exceptional, unique, or extraordinary <br />circumstances or conditions applying to the property <br />in question as to the intended use of the property that <br />do not aWlY generally to other properties in the dis- <br />trictJ <br />b. That such variance is necessary for the preservation <br />and enjoyment of a substantial property right similar <br />that possessed by other properties in the same <br />vicinity. The possibility of increased financial <br />return shall not in itself be deemed sufficient to <br />warrant a varianceJ <br />c. That the special conditions or circumstances do not <br />result from the actions of the aWlicantJ <br />d. That the granting of the variance requested will not <br />grant the applicant any special privilege that is <br />denied by this chapter to other owners of lands, <br />structures or buildings in the same district; <br />e. That the variance requested is the minimum variance <br />which would alleviate the hardship. Economic con- <br />siderations alone shall be considered a hardship; <br />f. That the variance will not be materially detrimental <br />to the purposes of this chapter, or other property in <br />the same zone; and <br />g. 'Ihat the variance will not substantially increase the <br />congestion of public streets, or increase the danger <br />of fire, or endanger the public safety, or substan- <br />tially impair property values within the neighborhood. <br /> <br />In granting a variance, the Board of Adjustment may impose <br />conditions to insure compliance and to protect adjacent <br />properties. <br /> <br />Within 60 days after receipt of filing of a request for a <br />variance or an appeal from an administrative order or <br /> <br />22 <br /> <br />- <br />
