For the purposes of calculating overtime, an employee using paid holidays, vacation leave, sick <br />leave, or compensatory time off is considered to be working. <br />Accrued compensatory time off may be used with prior approval from the employee's <br />Department Head or the Department Head's designee. Upon an employee's separation from the <br />City, accrued and unused compensatory time off will be paid out at the then -current hourly rate <br />of pay. <br />For the purposes of computing overtime compensation and compensatory time, overtime hours <br />worked shall not be pyramided, compounded, or paid twice for the same hours worked. <br />5.8 Severance Pay <br />Severance pay, based on eligible unused ESSTsick leave, is available to employees who have at <br />least five (5) years of regular service with the City and resign "in good standing". If the <br />employee is terminated because of malfeasance in office, gross misconduct, conviction of a <br />felony, or conviction for an illegal act involving personal gain to the employee, the employer <br />shall have no obligation to pay the aforementioned severance pay. <br />Eligible ESSTsick leave includes combined total of both traditional sick leave and earned sick <br />and safe time, is based on the percentages shown below: <br />Years of Continuous <br />Employment <br />Percentage of Unused <br />Accumulated Sick Leave <br />Payable <br />Additional 1O% With 3- <br />Month Notice of <br />Resignation <br />5 years <br />33% <br />43% <br />10 years <br />45% <br />55% <br />15 years <br />50% <br />60% <br />Eligible severance pay will be processed per the applicable PEHCSP agreement. <br />After five (5) years of continuous employment, EMPLOYEES who submit a letter of resignation <br />at least three (3) months (90 calendar days) in advance of their last day worked, shall receive an <br />additional ten percent (10%) added to the applicable years of service tier, to be deposited into the <br />employee's; Health Care Savings Plan <br />Receipt of severance pay terminates all seniority rights and ends all City of Ramsey liability with <br />regard to other benefits, except as otherwise provided by law and any applicable collective <br />bargaining agreement. <br />301Page <br />
