<br />PUBLIC HEARINGS/BOARD BUSINESS <br /> <br />. <br /> <br />Case #1: <br /> <br />Request for a Variance to Cul-de-Sac Length for the Proposed Subdivision of <br />Wild Oaks of Ramsey; Case of Ron Tallman <br /> <br />Chairperson Nixtclosed the regular portion of the Board of Adjustment meeting at 7:08 p.m. in <br />order to conduct the public hearing. <br /> <br />Public Hearin2 <br /> <br />Chairperson Nixt called the public hearing to order at 7:08 p.m. <br /> <br />Presentation <br /> <br />Associate Planner DaInes stated Ron Tallman has applied for preliminary plat to create 13 new <br />lots in a cluster subdivision. The applicant has requested a variance to cul-de-sac length of 600 <br />feet in order to extend Nutria Street as part of this development. She .explained the. proposed <br />subdivision requires a variance to the maximum cuI-de-sac length restriction of 600 feet in <br />Section 9.50.30 of City Code. The proposed Nutria Street extends approximately 1,100 feet from <br />the nearest outlet, resulting in a need for a variance of 500 additional feet. The southernmost lot <br />on the cul-de-sac extends approximately 900 feet from the nearest outlet, County Road 63. The <br />intent of the cul-de-sac requirement is to limit long stretches of roadway where emergency <br />vehicles may have difficulty reaching lots with water trucks. Also, the restrictions regarding cul- . <br />de-sac length are intended to limit the number of single-access homes in the City of Ramsey. <br /> <br />Associate Planner DaInes advised due to the encumbrance of wetlands on this site, any <br />development of this property would require a variance to cul-de-sac length without obtaining <br />additionalland or a second access through the property. However, the Fire Chief has indicated <br />that allowing an over-extended cul-de-sac may impact the public safety in an emergency. <br />Vehicles will have difficulty entering, existing, and maneuvering within the neighborhood. It is <br />Staffs opinion that ensuring public safetyis more compelling than easing a hardship caused by <br />wetlands. Therefore, Staff recommends denial of the variance due to the increased potential for <br />public safety hazard. <br /> <br />Citizen Input <br /> <br />Jim Maloney of John Oliver and Associates, representative of the applicant, stated they have <br />prepared the documents for preliminary plat for the Wild Oaks of Ramsey. Throughout this. <br />entire process Wild Oaks of Ramsey has addressed all of the comments the City has made, <br />including the waste water situation with the cluster septic, and they have put together a very <br />extensive final type design in the range of a $50,000 type .investment. Mr. Maloney reviewed a <br />drawing depicting the location of the Wild Oaks of Ramsey. He noted to the west of the parcel is 0.0 <br />a vacant, non-developed piece of land, and to the west of that parcel lies the Alida: subdiVision, <br />which has 171 st Avenue NW stubbed out. Wild Oaks of Ramsey has provided dedicated right- . <br />of-way within the plat for ultimate connection of 171st Avenue, and has also provided dedicated . <br />right-of-way on Nutria Street.for access to the south when that occurs.
