<br />Mr. Morton stated their rate design is based on costs and capital replac~ment. <br /> <br />. <br /> <br />Community Development Director Trudgeon presented staffs summary of the notes from the <br />February 21, 2006, Council Work Session. He asked if the Council would like to make any <br />changes to this s~mmary. <br /> <br />Mayor Gamecagreed that professional management needs to be included. He stated that the key <br />is to have a management company involved and the other question is whether the City can own <br />the land and have the management company involved without liability issues. He stated that he <br />thinks the management company will want to own the land. Mayor Gamec asked staff to raise <br />that question with the management company. <br /> <br />Councilmember Elvig asked staff to include a connection policy. <br /> <br />Community Development Director Trudgeon stated the second reading of the moratorium <br />ordinance will be on the Council's agenda and asked what happens if a project wants services <br />run in to their property. He stated staff would like to Write in an exception saying the <br />moratorium does not apply if a piece of land receives a Comprehensive Plan amendment by the <br />City Council and Metropolitan Council to have services brought in. <br /> <br />Councilmember Cook asked staff to obtain a legal opinion on whether this type of exception <br />< would require re-notification. <br /> <br />Community Development Director Trudgeon stated staff IS sorting through the pending <br />developments to see if the moratorium would effect them. <br /> <br />. <br /> <br />Councilmember Elvig sta:tedthere are two projects that have received preliminary plat approvals. <br /> <br />Councilmember Cook asked if the. City needs a one year moratorium or if a shorter time period <br />would be long enough to get the ordinance finished. <br /> <br />Councilmember Strommen pointed out that the moratorium can be taken off when the ordinance <br />is finished. <br /> <br />Mayor Gamec stated if the moratorium is set, it will be for one year. Then the Council will need <br />to get their work done. <br /> <br />Councilmember Cook stated he does not know whether he would support adopting a fuJ,! year <br />moratorium. He stated he thinks the City has been unfair to developers because they have been <br />pushed off several times while the Council has been working on the ordinance. He stated if the <br />moratorium is for one year, he thinks the Council will push off the work and stretch it out to one <br />year. <br /> <br />Councilmember Elvig noted that the City had it set at 90 days and did not get' even close to <br />finishing the ordinance.- <br /> <br />. <br /> <br />City Council Work Session / April 4, 2006 <br />Page 8 of 19 <br /> <br />-50- <br />
