<br />Ass't Community Development Dir/HRA Executive Dir. Frolik indicated Oakwood is seeking <br />direction as to what, if any, documents the developer could supply to give Council a level of <br />comfort at which they would consider allowing the developer to apply for final plat approval. If <br />Council allowed for the application to occur prior to receipt of the Certificate of Completion, the <br />plat would most likely be ready for Council review on August 8th. It is anticipated that the <br />MPCA Certificate of Completion will be available sometime in August also. To wait until the <br />Certificate of Completion is received to accept an application for final plat approval pushes the <br />Council review date out to the end of September in the best case scenario. Ms. Frolik explained <br />regarding the grading, the City has in previous cases entered into a Grading Agreement with <br />developers provided the final grading plans have been reviewed and approved by Engineering; <br />all necessary permits, such as WMO and MPDES, have been obtained; a cash escrow for <br />inspection fees have been provided; and a financial surety for the grading operations has been <br />established. <br /> <br />Jon Olson, Oakwood Land Development, explained it was originally planned that after the full <br />clean-up letter was received, the application would be submitted for final plat. He is not asking <br />to record the plat until the certification is in place; he is requesting that the final plat application <br />be processed while the MPCA is processing the clean-up record so they are ready to record the <br />plat when the Certificate of Completion is received from the MPCA. <br /> <br />Mayor Gamec noted the final plat approval would be contingent upon receipt of the Certificate <br />of Completion; many things are approved in the City with contingencies attached. <br /> <br />The consensus of the Council was to authorize staff to proceed with the above request of <br />Oakwood Land Development regarding application for final plat approval and a Grading <br />Agreement. <br /> <br />Ass't Community Development Dir/HRA Executive Dir. Frolik indicated the agenda of the June <br />13th Council meeting will include a case for Council authorization to proceed with this process. <br /> <br />Councilmember Jeffrey stressed that it must be clear to the residents what is being allowed to <br />happen with this development prior to the Certificate of Completion. <br /> <br />Mr. Olson informed the Council the market has deteriorated seriously; there is a precipitous <br />change in the real estate market that he has not seen in the past 35 years. A very good national <br />builder has pulled out of the Brookfield development. He stressed the need to closely watch <br />what is going on in the market. <br /> <br />Councilmember Strommen inquired about the status of a budget check on an upcoming work <br />session agenda. <br /> <br />City Administrator Norman indicated staff is contacting each developer to determine their <br />schedule. <br /> <br />Councilmember Elvig left the meeting at 7:08 p.m. <br /> <br />City Council Work Session / June 6, 2006 <br />Page 5 of9 <br />
