170.063 CASH PAYMENT In lieu of public land dedication for the purposes of parks, playgrounds, trails and /or open space as above described, the City Council may require the subdivider to contribute ten percent (10 %) of the fair market value of the undeveloped land no later than final plat approval, or Two Hundred Dollars ($200.00) per lot created, whichever is greater. The fair market value of the undeveloped land shall be determined by the tax assessments, records and formulas that apply thereto. The cash payments received as a result of this provision shall be placed in a special fund by the City and used only for acquisition of land for parks, playgrounds, public open space,. trails and storm water holding areas or ponds, development of existing parks and playground sites, public open spaces and storm water holding areas or ponds and debt retirement in connection with land previously acquired for such public purposes. 170.064 COMBINATION OF LAND DEDICATION AND CASH PAYMENT In plats, a combination of land and cash may be required by the City. 170.065 SCENIC EASEMENT In appropriate plats, as determined by agreement between the City Council and the subdivider, the subdivider may dedicate to the public a scenic easement in combination with the requirements of Section above or, if the subdivider and City Council agree, the scenic easement dedication may be in lieu of the requirements in Sections 170.066 AGREEMENT AS TO DEDICATION Agreements as to the requirements in Sections 170.061 through 170.064 above shall be made prior to preliminary plat approval. Failure of the City Council and subdivider to reach agreement regarding the matters in Sections 170.061 through .170.064 above shall constitute denial of -the preliminary plat. SECTION 2. REPEAL Section 170.06 of the Ramsey City Council entitled Dedication of Parks and Open Spaces adopted by Ordinance 83- 13 is hereby repealed. Jsk
