ORDINANCE 188- <br />CITY OF RAMSEY <br />ANOKA COUNTY <br />STATE OF MINNESOTA <br />AMENDMENT TO CHAPTER 170. known as the Planning, Subdivision and <br />Signs Chapter of Chapter 170. of the City Code. <br />AN ORDINANCE ADDING CHAPTER 170.06 to the City Code and repealing <br />Section 170.038F of the City Code and repealing Ordinance 83 -13. <br />The City of Ramsey ordains: <br />SECTION 1. AMENDMENT. <br />Chapter 170.06 of the City Code is amended as follows: <br />170.06 PARR AND OPEN SPACE DEDICATION <br />170.061 PURPOSE <br />The purposes of this section are to provide funds which the <br />City shall dedicate and use only for the acquisition of <br />parks, playgrounds, trails, and /or open space, as well as <br />provide a means for the City to acquire a reasonable portion <br />of each new subdivision for public use as parks, <br />playgrounds, trails and /or open space. <br />170.062 LAND DEDICATION <br />In all new subdivisions, eight percent (8 %) of the gross <br />area subdivided shall be dedicated to the public for public <br />use as parks, playgrounds, trails and /or open space. Along <br />with the dedication required in the previous sentence, <br />additional land amounting to a maximum of five percent (5 %) <br />of the gross area subdivided may be required to be dedicated <br />to the public for public use as storm water holding areas or <br />ponds. No area may be dedicated for public use until <br />written findings and recommendations regarding the proposed <br />dedications have been made by the planning commission and <br />presented to the City Council. The City Council shall not <br />approve the dedication of any areas for public use unless it <br />determines that such areas for public use are suitable and <br />needed for the public health, safety, convenience and /or <br />general welfare of the City, as a result of approval of the <br />subdivision. If the City Council determines that no areas <br />in the gross area to be subdivided are needed for storm <br />water holding areas or ponds, then the City Council may <br />require that the are dedicated to the public for public use <br />as parks, playgrounds and open space be increased to ten <br />percent (10 %) of the gross area subdivided. <br />15D <br />
