<br />, <br />" <br /> <br />.::1 <br /> <br />... <br /> <br />PR01O)FJ) SOtEE'l' CLNlSE <br /> <br />fOR DISCDSSI~ lORIQ;ES <R,Y <br /> <br />IN'IENT: It is the intent of this chapter to permit an existing non-conforming <br />use to continue Wltil it is rElllOVed, but not to encourage its use or <br />eXpulsion. <br /> <br />R:lrcnmmMING OSES: AffJ structure and/or use existing uIX>n the effective date <br />of the adoption of this ordinance may be continued as <br />long as it remains otherwise lawful provided that it <br />meets the following provisions. <br /> <br />1. No such use and/or structure shall be expanded or <br />enlarged except in oonformi ty wi th the provisions of this <br />ordinance. <br /> <br />2. A non-conforming use of a structure which has been <br />discontinued for a period of twelve (12) months shall not <br />be re-established and any further use shall be in <br />conformi ty wi th the regulations of this ordinance. <br /> <br />3. A non-conforming structure which is damaged by any <br />cause to the extent of more than fifty percent (50%) of <br />its market value as determined by the current records of <br />the City Assessor7 shall not be restored except in <br />conformity with the regulations of this ordinance. <br /> <br />4. Normal maintenance of a non-conforming use and/or <br />structure is permitted. Maintenance may include <br />necessary non-structural repairs and incidental <br />alterations which do not enlarge or intensify the non- <br />conforming use. <br /> <br />5. Buildings meeting Ci ty standards on setbacks as <br />listed in Section 170.016 shall in no case be considered <br />non-conforming for the setbacks. <br /> <br />6. Mlen arrj lawful non-conforming use has been changed <br />to a conforming use, it shall not thereafter be changed <br />to artj unlawful non-oonforming use. <br /> <br />7. 'Jhe zoning adninistrator shall conduct an inspection <br />on a periodic basis of all non-conforming uses and reIX>rt <br />the findings to the Planning and Zoning Commission and <br />the City Council within sixty (60) days for their <br />consideration. <br /> <br />:;0 <br />
