10 minutes

Case:# 1

AIRPORT ZONING OPTIONS

By: William K. Goodrich, city Attorney

Background:

As the Council will recall, you asked me to give a legal opinion
on certain zoning alternatives which the city has in light of the
results from the April 19th Airport Zoning Ordinance referendum.
I have done research on those alternatives which require a legal
interpretation. As of this date, I have not formed a final
conclusion on any issue. I have found no concrete law on the
issues raised, and therefore I believe it will be necessary to
seek an Attorney General's Opinion. The issues I recommend we
seek an opinion on are an interpretation of the City's Charter
section 5.07 and what degree of finality the referendum imposes
on additional airport zoning. Also, we should seek an opinion on
the relationship of Charter Section 5.07 to the Airport Zoning
Statutes, 360.063 et seg.

Recommendation:

Council Action:

Based on your discussion, you may want to authori~e the city
Attorney to seek an Attorney General's Opinion on those Airport
zoning alternative issues discussed above.

Review Checklist:

x
X

Chief of Police
Finance Officer
Public Works Superintendent
Other

Administrator
Attorney
Engineer
Community Develop-
ment Director

22-.
