Enclosure: <br />Settlement Agreement Format <br />Settlement Schedule <br />Recommendation: <br />CONFIRMATION OF POTASSIUM STREET <br />PROPERTY ACQUISITIONS <br />By: William K. Goodrich, City Attorney <br />Background: <br />As Council is aware the City commenced an eminent domain action to acquire the right -of -way <br />necessary for the improvement of Potassium Street. At a closed attorney /client meeting the Council <br />authorized settlement offers to the various property owners for payment of their respective damages. <br />Staff has been able to negotiate, the settlements with the owners and in the amounts described on <br />attached Schedule A. Also enclosed is the format for the legal document which will be signed by <br />the parties. Staff anticipates a negotiated settlement with the remaining parcel owners, Terry K. <br />Lamont and Mary L. Lamont very shortly. <br />Approve Settlement Agreement with the respective property owners. <br />Council Action: <br />CASE # <br />Approve Settlement Agreements with the respective property owners listed on the attached <br />Schedule A for acquisition of the Potassium Street right -of -way in the format as attached. <br />Reviewed by: <br />City Attorney <br />City Administrator <br />CC: 08.08.06 <br />
