Staff would like to meet with Bauerly <br />Companies, which was the lowest responsible bidder to see if they can move forward with the St. <br />Francis frontage road since that is the only project that had the assessments locked in. These <br />residents have been waiting over two years for something to happen with this street. <br /> <br />Councilmember Cook suggested using the finances that were to have gone towards Division B to <br />subsidize Division C so the more important projects can be completed. <br /> <br />City Engineer Jankowski replied it is an option to drop some of the projects to focus on some of <br />the more urgent projects. All of the roads are in need of overlays or they would not be on the <br />program. It may also be an option to look at capping the assessments at 110%. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Jeffrey, to table the award of <br />bids for Divisions B & C of the 2006 Street Maintenance Program, and to direct staff to look at <br />removing some of the projects and determine if funds that were to be used for Division B can be <br />utilized to complete the scope of Division C. <br /> <br />Further discussion: Public Works Director Olson explained it is not known whether the <br />contractor will honor the same price with projects being separated and a reduction in scope. <br />Councilmember Cook explained his suggestion is to complete the entire scope of Division C <br />utilizing funds that were going to be used for Division B. Councilmember Jeffrey stated he is in <br />agreement with giving staff a chance to review this. He asked if another public hearing process <br />will be required, and if there will be time to complete the work this year. Public Works Director <br />Olson replied the requirements of City Code need to be reviewed with the City Attorney. It <br />needs to be determined if it can be worked out within the context of the bidding laws that the <br />project could proceed if the residents are not assessed more than 10% of what was estimated at <br />the last public hearing. If another public hearing process is required with a 90 day waiting period <br />the work will not be able to be completed this year. Councilmember Olson stated she has real <br />concerns about moving this project to next year, and the price of oil will not go down. She <br />would be in favor of whatever can be done to work this project in this year. <br /> <br />Motion carried. V oting Yes: Mayor Gamec, Councilmembers Cook, Jeffrey, Olson, Pearson, <br />and Strommen. Voting No: None. Absent: Councilmember Elvig. <br /> <br />Case #3: <br /> <br />Consider Approval of Acquisition of Easements for the NW Trunk Sanitary <br />Sewer Extension <br /> <br />Public Works Director Olson indicated this item is similar to those in front of the Council during <br />negotiations for the County Ditch 66 easement acquisition process. Staff has been working with <br />Gerald Dvorak to obtain the ditch easement across his property. Mr. Dvorak has agreed to <br />transfer an easement to the City for $5,000. This amount is commensurate with similar <br />easements obtained for this project. Staff recommends approval of the completed negotiations <br />with Mr. Dvorak in the amount of $5,000, contingent on Mr. Dvorak signing the easement. <br /> <br />City Council!
