<br />A bill for an act <br /> <br />relating to city home rule charters; modifying provisions for <br />amendments and elections; clarifying relationship to comprehensive <br />municipal plans; amending Minnesota Statutes 1996, sections 41 0.1 0, <br />subdivisions 1 and 2; 410.12, subdivision 1; and 473.852, subdivision <br />9. <br /> <br />BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: <br /> <br />Section 1. Minnesota Statutes 1996, section 410.10, subdivision 1, is <br /> <br />amended to read: <br /> <br />Subdivision 1. [TIMING; PROCEDURE; RECALL] Upon delivery of such <br /> <br />draft, the council or other governing body of the city shall cause the proposed. <br /> <br />charter to be submitted at the next general election or special election thereafter <br /> <br />occurring in the city within six months after the deliver of such draft, and if there <br /> <br />ic no general oity election ooourring in the oity within six months after the delivery <br /> <br />of suoh draft, then the oounoil or other governing body of the city shall oause the <br /> <br />proposed oharter to be submitted at a speoial election to be held within 90 days <br /> <br />after the delivery of ouoh draft. The council or other governing body may call a <br />special election for that purpose ooty at any time. If the election is held at the <br /> <br />same time with the general election, voting places and election officers shall be <br />the same for both ~Iections. At any time before the council has fixed the date of <br />the election upon the proposed charter, the charter commission may recall it for <br /> <br />further action; and the council may authorize recall of the charter by the <br /> <br />commission at any later date prior to the first publication of the proposed charter. <br /> <br />3 <br />
