<br />CASE NO. g <br /> <br />CONSXDER AUTHORXZiNG CiTY EFFORT <br />TO SEEK AK:~NDHENTS TO STATE STATUTES RELATiNG TO <br />CHARTER AND CHARTER AMENDMENT STATUTORY PROCED:-RES <br /> <br />By: william K. Goodrich, city Attorney <br /> <br />Background: <br /> <br />The Mayor has directed staff to review and where necessary draft <br />amendments to certain state statutes relating to Charters and state <br />Charter Amendment procedures. The Mayor is of the opinion that the <br />present state Charter Amendment procedures do not afford a <br />reasonable opportunity for all residents to be informed and <br />involved in Charter Amendment decisions. with this directive in <br />mind, we are proposing state statute amendments to: <br /> <br />(1) Permit city councils to schedule all amendment referendum <br />elections on general election days; <br />(2) Specifically allow city councils to expend public funds <br />advising voters of relevant facts reh~ting to Charter <br />Amendment questions;" <br />(3} Requiring Charter Amendment circulators to present their <br />proposed amendment to the City's Charter commission for <br />review and comment prior to circulating the petition: and <br />(4) Clarifying that Charters and Charter Amendments are <br />"official controls" as defined by Statue and as such must <br />be in compliance with the city's comprehensive plan. <br /> <br />Attached is the proposed State statute legislation for your review. <br /> <br />Recommendation: <br /> <br />Based on discussion and for your consideration, attached is a <br />proposed resolution for consideration. <br /> <br />council Action: <br /> <br />Motion to adopt Resolution 98-01- which is a resolution of <br />support for State legislation amending certain state statutes <br />relating to Charters and Charter Amendment procedures. <br /> <br />Review Checklist: <br /> <br />Acting city Administrator <br /> <br />~ <br /> <br />, <br />l ~ <br /> <br /> <br />~~'ll <br />~~\~\~;:\ <br /> <br />dt.I~ <br />
