<br />i <br />r <br /> <br />2. That the exception is necessary for the preservation and <br />enjoyment of a substantial property right of the <br />petitioner. <br /> <br />3. That the granting of the exception will not be <br />detrimental to the public welfare or injurious to other <br />property in the area in which the property is situated. <br /> <br />4. That the proposed exception will be harmonious with and <br />in accordance with the specific objectives of the city's <br />existing Comprehensive Plan and will not adversely affect <br />the planning process for adoption of amendments to the <br />Comprehensive Plan above described. <br /> <br />5. That the proposed use/subdivision will be consistent with <br />the intent and purpose of this ordinance. <br /> <br />SECTION 7. TERM. <br /> <br />The term of this Ordinance shall be for a period of one year <br />commencing with its effective date. The term may be extended after <br />approval by the city council for an additional period not exceeding <br />lB months, as provided for in Minnesota statutes, section 462.355, <br />Subd. 4. <br /> <br />SECTION 8. PENALTIES. <br /> <br />Any person, firm, entity or corporation that subdivides or <br />undertakes any development activity in violation of the provisions <br />of this ordinance shall be guilty of a misdemeanor and shall be <br />subject to any additional legal or equitable remedies available to <br />the city. <br /> <br />SECTION 9.
