<br />CASE # Fe.3 <br /> <br />SECTION #22 DRAINAGE EASEMENT ACQUISITION <br />By: Steve Jankowski, City Engineer <br /> <br />Background: <br /> <br />On November 14, 1995, I reported that I would initiate action on the acquisition of <br />easements for Improvement Project #95-12. As you will recall, the Council directed a <br />notice of condemnation to be served on Parcel 11, the Stanley Welsh property. The <br />remaining 13 property owners were sent a letter on November 7, 1995, offering the <br />purchase of the drainage easement at a unit price of $1,000 per acre. This results in a range <br />of $10 to $430 for 13 parcels. <br /> <br />Since the letter offers were mailed, I have spoken with ten of the remaining 13 property <br />owners. One easement has been acquired and four additional property owners indicated <br />they would be accepting the offer. I hope to be able to contact the remaining property <br />owners by the Finance Committee meeting and be in a position to summarize their positions <br />regarding the easement acquisition. <br /> <br />I would anticipate that I would be authorized to settle a compensation amount with some <br />property owners, directed to negotiate further with other property owners, and proceed to <br />condemnation for those owners who do not appear willing to settle on a reasonable <br />amount. <br /> <br />Committee Action: <br /> <br />Based upon discussion. <br /> <br />Reviewed by: <br /> <br />City Engineer <br />City Administrator <br />Finance Officer <br />City Attorney <br /> <br />FC: 11/28/95 <br /> <br />/jmt <br />
