<br />4. The haul route for the Itasca Shores Proposal shall be directly onto 153rd Avenue and then <br />directly to Hwy. #10, unless the material is used for berms along 153rd Avenue in Section 19 <br />(Northfork property). <br /> <br />5. All grading operations shall be conducted in accordance with the following plans: <br /> <br />Highlands Proposal- One sheet dated received by the City on July 21, 1997 prepared by <br />Ulteig Engineers, Inc. <br />Lake Proposal - One sheet dated May 16, 1995 prepared by Ulteig Engineers. <br />Links Proposal - One sheet dated April 16, 1996 prepared by Kemper and Associates. <br />Itasca Shores Proposal - One sheet dated November 20, 1995, prepared by Ulteig Engineers. <br /> <br />6. All equipment used for grading and hauling operations shall be maintained and operated in <br />such a manner to minimize noise, dust, and vibrations adversely affecting surrounding <br />properties. All equipment shall be kept in good repair. Failed equipment and rubbish shall be <br />removed from the work site regularly. <br /> <br />7. All work sites shall be properly safeguarded to prevent the general public from depositing <br />garbage or other refuse on the work site. <br /> <br />8. Existing tree and groundcover shall be preserved to the extent feasible. <br /> <br />9. Grading operations shall be conducted in such a manner to minimize interference with the <br />surface water drainage outside the boundaries of the operation. <br /> <br />10. Fencing may be ordered by the City Council or City Engineer anytime the permit is in force <br />and shall be installed within 24 hours of written notice. <br /> <br />11. All haul roads to and from the Subject Property shall be maintained in order to minimize dust <br />and in a condition satisfactory to the City Engineer. This work shall include application of <br />water, bituminous material, or calcium chloride to the road surface as may be necessary to <br />alleviate dust nuisance and eliminate traffic hazards. This work shall also include daily <br />inspections of all haul roads and the removal of spillage of any materials from the operation. <br />When hauling operations are completed, the permit holder shall either restore that haul road to <br />a condition at least equal to that which existed at the time the hauling operations were started, <br />or compensate the local road authority in an amount satisfactory to that road authority and <br />concurred in by the City Engineer for the restoration of that haul road. The City Engineer will <br />then accept such restoration or concur in such financial settlement for the restoration of the <br />haul road in writing and such acceptance will relieve the permit holder of any additional <br />obligation in connection with the restoration of the haul roads. If the permit holder fails or <br />refuses to perform haul road restoration or to make satisfactory financial settlement for such <br />restoration, the City will cause the restoration work to be done and require reimbursement <br />from the financial guarantee required herein. <br /> <br />~1 <br />
