<br />Councilmember <br /> <br />moved for the adoption of the following findings offact: <br /> <br />RESOLUTION #97- <br />A RESOLUTION ADOPTING FINDINGS OF FACT RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT <br />FOR A PERSONAL COMMUNICATION SERVICE (peS) TOWER <br /> <br />WHEREAS, American Portable Telecom (APT), hereinafter referred to as <br />"Applicant", has properly applied for a Conditional Use Permit to construct, install and <br />operate a telecommunications site on the property legally described as follows: <br /> <br />The north 426.29 feet as measured along the West Line of that part of the <br />Southwestern Quarter of the Southeastern Quarter of Section 11, Township 32, Range 25, <br />Anoka County, Minnesota, lying westerly of the centerline of State Highway No. 47 <br />(subject to road and highway easements over the north and east 33 feet). <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as <br />follows: <br /> <br />1. That the Applicant appeared before the Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the Ramsey City Code on August 5, 1997, and that <br />said public hearing was properly advertised and that the minutes of said public <br />hearing are hereby incorporated by reference. <br /> <br />2. That the Subject Property is located in the Business District, is approximately 4.2 <br />acres in size, and is owned by Rum River Plaza Associates. <br /> <br />3. That the Applicant is proposing to lease a 50' x 50' section of the Subject <br />Property (site) to facilitate the development of the tower. <br /> <br />4. That the site to the north is zoned Business, the sites to the south and west are <br />zoned Rural Residential, and the site to the east is zoned for a Planned Unit <br />Development. <br /> <br />5. That the Applicant is proposing to place a 50 meter (approximately 165 feet) <br />monopole, and equipment cabinets on the site, all of which will be encompassed <br />by an eight foot high chain link fence topped with three strands of barbed wire. <br /> <br />6. That the Applicant is proposing to plant red cedar trees around the perimeter of <br />the cell site. <br /> <br />13 <br />
