<br />CASE #t:t <br /> <br />PROPOSED ORDINAJ'TCE AMENDING SECTION 9.11.18 (GRADING, <br />MINING AND FILLING PERMITS) OF THE RAMSEY CITY CODE <br />By: City Engineer Steve Jankowski and Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Last month City Staff processed a grading and mining permit which involved excavations below <br />an elevation six feet above the elevation of the water table. It was noted at the time that this is in <br />direct conflict with City Code, and the basis for this restriction was unlmown. The City Engineer <br />has been in contact with DNR, the Anoka Soil and Water Conservation District, and the Board of <br />Soil and Water Resources, and the basis of such a restriction in our zoning ordinance remains <br />unknown. As a matter of fact, the Conservation District and the DNR encourage the construction <br />of ponds under certain conditions. <br /> <br />Observations: <br /> <br />On September 23, 1997, the above information was reported to City Council, and they directed <br />City Staff to initiate action to amend City Code t) allow for the construction of ponds under <br />certain conditions. The proposed ordinance amendment is enclosed for your review and <br />information. <br /> <br />Recommendation: <br /> <br />City Staff recommends adoption of the proposed ordinance amendment. <br /> <br />Commission Action: <br /> <br />Motion to recommend that City Council adopt the proposed ordinance to amend Chapter 9 of the <br />City Code to allow for the construction of ponds under certain conditions. <br /> <br />Reviewed by: <br /> <br />City Attorney <br /> <br />PC: 10/07/97 <br /> <br />~1 <br />
