Complete Complete Complete Complete t:to Monthly Status Report 7/7/97 Attach to the record of the Kurak public hearing the letters received from Ray Kellas, Barry Childs, Jerry and Maryjeanne Arneson, and Torn and Julie Schacht. 7/7/97 Attach to the record of the Grinde public hearing the letter of support signed by neighbors. 7/7/97 Kurak Findings of Fact - The J:>1al1!ling Commission voted to accept 1 to 11, 14, 16, and 17 as presented and amend the following: (12) Indicate 39 acres. (13) Indicate 800,000 cubic yards. (15) Indicate 300 feet north of the northern end of Sunfish Lake. (18) To read "That the existing drainage patterns will not be substantially altered by the proposed grading plan." (19) Indicate "in active area only" at the end of the sentence. (20) To read "That the grading operation will not increase the traffic to and from the subject property for the period of time the permit is in effect." (21) To read "That the proposed use will not be unduly dangerous or otherwise detrimental to persons residing or working in the vicinity of the use or to the public welfare." (22) To read "That the proposed use will not substantially adversely impair the use, enjoyment, or market value of any surrounding property." (23) Split into two findings - (23a) Indicate will not be hazardous; and (23b) To read "That the proposed use will be disturbing to existing or future neighboring uses." (24) Delete. (25) To read "That the proposed use will be served adequately by public facilities and services such as highways and streets." (26) To read "That the proposed use will not create excessive additional requirements at public cost for public facilities and. services, and it will not be detrimental to the economic welfare of the community." (27) Indicate that proposed uses and activities are controlled by City Code and should the permit be granted, these private rights will be protected by the' Code underthecontract the permittee signs with the City. Add a finding indicating that the excavation on the southeast side of the project will leave an 18- foot-high bluff along Sunfish Lake and a 13-foot-high bluff on the eastern wetland. The Planning Commission voted to recommend approval of the amended Findings of Fact. Forward to Council. 7/7/97 Kurak grading and mining CUP - The Planning Commission . voted to amend the following terms: (3) Indicate 39 acres. (7) Add "excepting personal property" at the end of the sentence. (14) Increase the interval to two days. The Planning Commission voted to recommend City Council approve Torn Kurak's request for a CUP to grade and export soils. Forward to Council.
