<br />Accessory farm buildings housing animals may not be within 75 feet of neighboring property <br />line <br /> <br />Driveways shall not exceed 20 feet in width at the point where it adjoins the street <br /> <br />Driveways shall maintain a 3 foot side yard from adjacent side yards <br /> <br />Driveway access shall not be allowed on to designated collector or thoroughfare streets. <br /> <br />Development eligibility within the R-IR zoning district. <br /> <br />Intent: The "4 in 40" overlay district provides a density of development which is significantly <br />lower than that previously permitted. As a result, the eligibility of parcels to develop is <br />determined in accord with the following: <br /> <br />The size of the parcel which shall determine the number of eligible residential units which can be <br />developed on the parcel will be the parcel size and state of development as of January 1, 1990. <br /> <br />When a parcel acreage is not evenly divisible by ten allowing for a pro rata density of four units <br />per 40 acres, an additional lot may be developed only if the size of the fractional parcel is at least <br />75% ofthat required for a single or an additional lot. Eligible units per parcel are as follows: <br /> <br /> Eligible <br />Parcel Size Units <br />7.5 to 17.49 acres 1 unit <br />17.5 to 27.49 acres 2 units <br />27.5 to 37.49 acres 3 units <br />37.5 to 4D.0 acres 4 units <br /> <br />Development limitations <br /> <br />1. All subdivisions in the R-IR zoning district shall be platted and the following covenants at a <br />minimum shall be filed on the final plat: <br /> <br />a. A covenant clearly stating the development eligibility status of the <br />parcel. <br /> <br />b. A covenant clearly restricting the development of the remainder of the <br />parcel if all land is not fully incorporated into building lots. <br /> <br />c. A covenant stating that "4 units in 40 acres" development restrictions <br />shall apply to the land until such time that a higher density <br />development is permitted by City Code. <br /> <br />d. In the City's designated Rural Area only, a covenant stating that the <br />area is rural and that commercial agriculture and other rural land use <br />activities will likely be occurring in the area. Complaints relating to <br />these activities shall be considered unwarranted so long as such <br /> <br />3S <br />
