<br />CASE # ;t <br /> <br />REQUEST FOR A VARIANCE TO MINIMUM LOT WIDTH, LOT AREA AND <br />ORDINARY IDGH WATER SETBACK; CASE OF GARY LIEN <br />By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Section 9.21.07 of the Ramsey City Code states that no lot that is substandard in width <br />and area by today's standards may be developed if it is under the same ownership as one <br />of the adjacent parcels. Gary Lien purchased Lots 15 and 16 in Bowers Mississippi Acres <br />in 1978. He lives on Lot 16 and desires to sell Lot 15 at this time as a buildable lot. <br />Under the aforementioned rule in Section 9.21.07, he needs a variance to lot width and <br />area to render the lot a buildable lot. In addition, he is proposing that the subject property <br />have a structure setback similar to that of Lot 16, 100 feet from the ordinary high water <br />(OHW) mark. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Certificate of Survey dated 1981 and applicants written statement <br />c) Proposed findings of fact <br />d) Proposed variance <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to owners of property within 350 <br />feet of the subject property. Staff attempted to notify property owners within 600 feet of <br />the subject property and the Department of Natural Resources. <br /> <br />Observations: <br /> <br />The parcels are in the Scenic and Critical River Overlay districts. The subject property <br />was platted in 1948, has a lot width of 80 feet and is approximately 1 acre in size. Under <br />today's standards, the minimums are 2.5 acres in size and a 200 foot lot width. Code also <br />states that any substandard lot by todays standards is considered buildable unless it is <br />under the same ownership as one of the adjacent substandard parcels. If it is under the <br />same ownership as an adjacent parcel with a principal structure on it, the vacant parcel is <br />not considered buildable and the area of same must augment the area and width <br />deficiency of the lot that is built on. When the applicant purchased Lots 15 and 16 of <br />Bowers Mississippi Acres in 1978, both of the lots were considered buildable. The duo- <br />ownership rule came into effect in 1985 and rendered Lot 15 unbuildable. <br /> <br />Since the new rules in 1985, four homes have been developed on lots in Bowers Drive <br />that are substandard by today's standards.
