That case, Mr. <br />Lien's case and 6 others total 8 cases of duo-ownership lots on Bowers Drive where one <br />lot is developed and the second is vacant. <br /> <br />The Scenic River rules provi~es for a setback from the river similar to that pattern <br />established by adjacent structures. The Shoreland rules provide for an average setback <br />from the river based on the setbacks of adjacent structures. It would appear that some <br />provision for an adjusted setback in the Critical River rules may have inadvertently been <br />omitted. <br /> <br />Recommendation: <br /> <br />It is Staff's opinion that the duo-ownership rule is practically impossible to enforce <br />thoroughly and equitably. Staff recommends that a variance to lot width and area be <br />granted to Lot 15 in order that it may be developed with a dwelling unit. Staff also <br />recommends that a variance to the river setback be granted based on the average setback <br />of the two nearest structures.
