<br />7. That due to its unique shape, location, and wetlands, the Subject Property cannot meet the <br />intent of Section 9.50.30, Subd. 2(b) without exceeding the 600 foot cul-de-sac length <br />restriction in Section 9.50.30, Subd. 3(g) for the following reasons: a) the current length of <br />Argon exceeds the 600 foot maximum as a result of a variance granted in 1993; b) <br />connection to the west onto T.R. #47 would not be allowed since it would not comply with <br />the access management spacing proscribed for TH 47; c) an outlet to Waco Street to the east <br />is obstructed by existing homes; d) a future road connection to the south is not feasible or <br />warranted because it would require the filling of wetlands. <br /> <br />8. That the basis for the 600 foot cul-de-sac length restriction relates to the fact that water has to <br />be trucked into rural areas not served by municipal water and fire trucks typically were <br />equipped with 600 feet of hose. <br /> <br />9. That the Subject Property is in the urban service area and there currently is one fire hydrant <br />on Argon Street N.W. and an additional fire hydrant will be required within the boundaries of <br />Amber Ridge 2nd Addition. <br /> <br />10. That the special conditions causing the undue hardship do/do not result from the actions of <br />the Applicant. <br /> <br />11. That if granted, the variance will not grant the Applicant any special privilege that is denied <br />to other owners of lands, structures, or buildings in the same district. <br /> <br />12. That if granted, the variance will not be materially detrimental to the purposes of the Ramsey <br />Zoning Chapter. <br /> <br />13. That if granted, the variance will not substantially increase the congestion of public streets, or <br />increase the danger of fire, or endanger the public safety, or substantially impair property <br />values within the neighborhood. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Cleveland, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Nixt <br />Board Member Cleveland <br />Board Member Brauer <br />Board Member Hunt <br />Board Member Levine <br />Board Member Trites Rolle <br />Board Member Van Scoy <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />Resolution #06-07-203 <br />Page 2 of3 <br />
