Commission Business <br />Chairperson Nixt called the regular meeting of the. Planning Commission back to order at 8:57 <br />p.m. <br />Chairperson Nixt asked if this was voluntary compliance and had anyone filed a complaint. <br />Associate Planner Geisler responded it was voluntary compliance and they had not received any <br />complaints. <br />Motion by Chairperson Nixt, seconded by Commissioner Cleveland, to recommend that the City <br />Council adopt Findings of Fact, positive to Scott Johnson's request for a home occupation <br />permit. <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Cleveland, Brauer, Hunt, <br />Levine, Trites Rolle, and Van Scoy. Voting No: None. Absent: None. <br />Motion by Chairperson Nixt, seconded by Commissioner Trites Rolle, to recommend that the <br />City Council approve Scott Johnson's request for a home occupation permit based on the <br />Findings of Fact. <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Trites Rolle, Brauer, Cleveland, <br />Hunt, Levine, and Van Scoy. Voting No: None. Absent: None. <br />Case #5: Public Hearing — Request for Interim Use Permit to Allow a Drive -Thru <br />Facility to be Constructed in the TC -1 Town Center Core Area; <br />Case of Sharp & Associates <br />Chairperson Nixt closed the regular portion of the Planning Commission meeting at 8:59 p.m. in <br />order to call the public hearing to order. <br />Public Hearing <br />Chairperson Nixt called the public hearing to order at 8:59 p.m. <br />Presentation <br />Associate Planner Dalnes advised that the City received an application from Sharp and <br />Associates to construct a drive -thru for a coffee shop that will be occupying the ground floor of <br />Ramsey Office Plaza located in the Town Center -Core Area. Drive -thrus are not a permitted or a <br />conditional use in this district. This request was brought forward to a City Council work session <br />because drive -thrus are prohibited within TC -1. At the May 30` work session, it was the <br />consensus of the Council that drive -thrus should not be permitted within this district. However, <br />the City Council met again at a work session on June 27, 2006, and determined that it might be <br />reasonable to allow this use on a use - specific basis through the use of the interim use permit. <br />Planning Commission /August 3, 2006 <br />Page 9 of 16 <br />
