Absent: None. <br />Case #4: Public Hearing — Request for a Home Occupation Permit; Case of <br />Scott Johnson <br />Chairperson Nixt closed the regular portion of the Planning Commission meeting at 8:55 p.m. in <br />order to call the public hearing to order. <br />Public Hearing <br />Chairperson Nixt called the public hearing to order at 8:55 p.m. <br />Presentation <br />Associate Planner Geisler explained the City has received an application from Scott Johnson for <br />a home occupation permit to operate a family -run wholesale bakery in the basement of his home <br />located at 5560 l44 Avenue NW. She indicated Mr. Johnson was proposing to establish a <br />family -run wholesale bakery in the basement of his home. The business, Jenny Ann Cakes, <br />consists entirely of baking cakes and delivering them to clientele. There is no frying or grease <br />used in the baking process. Mr. Johnson and his wife deliver the cakes by personal vehicle to <br />clients' homes and/or to multiple business locations in the metro area. She noted there are no <br />sales transactions that occur on site and thus, no customers coming to or from the home. She <br />noted City Code restricts home occupations to 20% of the gross floor area of the home. The <br />proposed bakery operation would be conducted in a portion of the basement that constitutes <br />roughly ten percent of the gross floor area of the dwelling. The only employees involved with <br />this business are Mr. Johnson and his wife, both of whom reside on the premises. Since there are <br />no on -site sales involved in the business, there is no need for additional off -street parking spaces. <br />There will be few, if any, deliveries to the home, as Mr. Johnson and his wife pick up all <br />ingredients themselves. All necessary equipment and appliances are typical residential units with <br />standard voltage. There will be no exterior evidence of the business; no signs will be displayed <br />and there will be no outside storage of equipment or merchandise. She recommended approval <br />of the request. <br />Citizen Input <br />There was none. <br />Motion by Chairperson Nixt, seconded by Commissioner Van Scoy, to close the public hearing. <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Van Scoy, Brauer, Cleveland, <br />Hunt, Levine, and Trites Rolle. Voting No: None.
