<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /><I <br />I <br />I <br />I <br />I <br />I <br /> <br />Mississippi Critical River District <br /> <br />Minimum Lot Size: Five (5) acres outside of the MUSA which are within the district with a <br />maximum density of 4 units per 40 acres on a pro rata basis. <br /> <br />Development Limitations: <br /> <br />A All subdivisions in the R-1 R District shall be platted and the following covenants at a <br />minimum shall be filed with the final plat: <br /> <br />A covenant clearly stating the development eligibility status of the parcel. <br /> <br />A covenant clearly restricting the development of the remainder of the parcel if all <br />land is not fully incorporated into building lots. <br /> <br />In the City's designated rural area only, a covenant stating that the area is rural and <br />that commercial agriculture and other rural land use activities will likely be <br />occurring in the area. Complaints relating to these activities shall be considered <br />unwarranted so long as such activities are being conducted in a lawful manner in <br />accordance with existing standards. <br /> <br />If the home sites include any environmentally sensitive land, a covenant shall clearly <br />state any restrictions on clear cutting, vegetation removal, erosion control, or other <br />controls necessary to protect the environmental resource. <br /> <br />A covenant stating that buildings will be situated on the lots permitting subdivision <br />of the plat and urban densities in the Urban Reserve and Urban Transition Areas. <br /> <br />B. Wetlands, floodplain, or other land within the parcel, may be attached to one of the lots <br />in the subdivision or in a lot to be owned in common by all of the lots in the subdivision. <br />A lot to be owned in common shall have a minimum dimension of 200'; such a lot must <br />abut or have access from all Jots having common ownership. <br /> <br />C. Park dedication requirements in the 4/40 districts shall be calculated based on the new <br />Jots being created and not on the non-developable remainder. <br /> <br />D. In cases where the development of the lots create a substandard lot size, said piece shall <br />be included in the lots by reconfiguring the Jot lines or shall be attached to the adjoining <br />lot. <br /> <br />E. All new lots shall be served by either an existing public road or new public road built to <br />public road standards. Lots shall be configured to allow for future development of public <br />roads to access remaining parcels restricted from development under this ordinance. <br /> <br />F. In the Urban Reserve and Rural Transition Districts, the subdivider must file a sketch <br />plan with the preliminary plat illustrating the reasonable resubdivision of the plat to <br />urban densities. <br /> <br />Conformina Use Designation for Existina Uses <br /> <br />No uses lawfully existing in the Rural Residential District prior to January 1, 1990 shall be <br />considered a non-conforming use as a result of adoption of the residential density overlay <br />district. <br /> <br />45 <br />
