system or discharges sewage in a manner which involves the <br />knowing and material variation from the terms and <br />specifications contained in the application or permit. <br />c. Violates the terms of an order issued pursuant to the <br />provisions contained herein. <br />d. Conducts the business of or engages in activities <br />described in Section 150.01.5F herein without first having <br />obtained the required license. <br />e. Willfully fails to conduct the testing or cleaning <br />obligations established pursuant hereto or unlawfully <br />refuses a right of entry to the administration when <br />requisite notice has been provided. <br />The plumbing inspector may by written order suspend or revoke any <br />disposal or system permit when he has information indicating that <br />the permit has been issued in error or on the basis of incorrect' <br />or inadequate information or that work is not being performed in <br />compliance with this ordinance or the provisions of any permit <br />issued hereto. <br />Cease and Desist Order. The administrator may issue an order to <br />the owner or occupant of any premises utilizing an individual <br />sewage treatment system to cease and desist the use of any system <br />which is operating in a manner creating substantial hazard to the <br />public, health, safety, or welfare or which has not been repaired <br />in accordance with the provisions of an order issued pursuant to <br />Section 150.01.8 herein. A noticed public hearing shall be held <br />within 14 days following the issuance of such an order to <br />determine whether the order should be continued in force and <br />effect. <br />The plumbing inspector may cause to be assessed against the <br />property on which an individual sewage treatment system is <br />located the cost of proper closure, restoration and cleanup of <br />pollution occurring as a result of a system failure. Upon <br />certification by the accountant of the cost incurred, the City <br />Administrator shall cause the cleanup assessment to be levied <br />against the property on which the system is located. <br />Liability <br />The plumbing inspector or any employee charged with the <br />enforcement of this Chapter of the City, acting in good faith and <br />without malice for the discharge of his duties, shall not thereby <br />render himself liable personally, and he is hereby relieved from <br />all personal liability for any damage that may accure to persons <br />or property as a result of any act required or by reason of any <br />act or omission in the discharge of his duties. Any suit brought <br />against the plumbing inspector or employee because of such act or <br />omission performed by him in the enforcement of any provision of <br />this chapter shall be defined by the legal department of the City <br />
