Criteria For Health Hazard <br />Criteria for determination that a system is a health hazard shall <br />include, but not be limited to, the following: <br />Right To Repair <br />In case the owner shall fail, neglect, or refuse to comply with <br />the notice to repair or rehabilitate or abate as described in <br />Section above, the city council may order the owner of the <br />building prosecuted as a violator of the provisions of this <br />ordinance and may order the plumbing inspector to proceed with <br />the work specified in such notice. A statement of the cost of <br />such work shall be transmitted to the city council, who shall <br />cause the same to be paid and levied as a special assessment <br />against the property. <br />Costs <br />b. The exposure for more than seventy -two (72) hours of an <br />on -site system or part thereof that is in use; <br />c. A system in which the level of effluent is sufficiently <br />close to the ground surface to result in offensive odors. <br />Costs incurred under Section 150.01.8D shall be paid out of the <br />city's general fund. Such costs shall be charged to the owner of <br />the premises involved as special assessment on the land on which <br />the building or structure is located, and shall be collected in <br />the manner provided for special assessments. <br />ADMINISTRATION <br />Enforcement <br />a. The appearance of on -site disposal system effluent into <br />surface waters at any time, or on the ground surface <br />continuously or intermittently over a period of fifteen (15) <br />consecutive days. <br />Any person who commits any of the following acts or violates any <br />of the provisions of this chapter which prescribe that certain <br />action is unlawful shall be guilty of a misdemeanor, and upon <br />conviction thereof shall be fined in an amount not to exceed <br />$700.00 for each violation and /or 90 days in jail. Each day that <br />unlawful activity continues shall constitute a separate <br />violation: <br />a. Disposes of sewage or installs or renovats an individual <br />sewage treatment system without first having received a <br />permit as provided herein. <br />b. Installs or renovates an individual sewage treatment <br />
