<br />DEVELOPMENT ELIGIBILITY WITHIN THE R-1R ZONING DISTRICT <br />,.. <br /> <br />INTENT: The "4 in 40" overlay d-lstrict provides a density of <br />development which is sianificantl v lower than that previous 1 y <br />permitted. Asa result. the eliaibilitv of parcels to develop is <br />determined in accord with the followina: <br /> <br />The size of the parcel which shall determine the number of eliaible <br />residential units which can be developed on the parcel will be the <br />parcel size and state of development as of January 1. 1990. <br /> <br />When a parcel acreaae is not evenlY divisible bv ten (10) allowina <br />for a pro rata density of four (4) units per forty (40) acres. an <br />additional lot may be developed only if the size of the fractional <br />parcel is at least 75% of that required for a sinale or an <br />additional lot. Eliaible units per parcel are as follows: <br /> <br />Parcel Size <br /> <br />Eliaible Units <br /> <br />7.5 to 17.49 acres <br />17.5 to 27.49 acres <br />27.5 to 37.49 acres <br />37~5 to 40.0 acres <br /> <br />1 unit <br />2 units <br />3 units <br />4 units <br /> <br />DEVELOPMENT LIMITATIONS <br /> <br />. ~ <br /> <br />A. All subdivisions in the R-1R zonina district shall be platted <br />and the followina covenants at a minimum shall be filed on the <br />final plat: <br /> <br />A covenant clearlY statina the development eliaibilitv <br />status of the parcel. <br /> <br />A covenant clearl v restrictina the development of the <br />remainder of the parcel if all land is not fullY incorporated <br />into buildina lots. <br /> <br />A covenant statina that "4 units in 40 acre" development <br />restrictions shall applvto the land until such time that a <br />hiaher densitv.development is .permitted bv ordinance. <br /> <br />- In the city's desianated Rural Area onlY. a covenant statina <br />that the area is rural and that commercial aariculture and <br />other rural land use activities will likelY be occurrina in the <br />area. Complaints relatina to these activities shall be <br />considered unwarranted so lona as such activities are beina <br />conducted in a lawful manner in accordance wi th existina <br />standards. <br /> <br />; <br /> <br />17 <br />
