Staff has <br />also reviewed supporting information and recommendation sent by the Metropolitan Council staff to <br />DNR which was received on April 17, 2001. Under ~ Statutes, section 116G.10, subd. 3 and MN <br />Rules, part 4410.9500, subp. 3, amendments of plans affecting lands within the Critical Area Corridor <br />and which relate to Executive Order 79-19 purposes, standards, and guidelines, shall become effective <br />only upon the approval of the'Department of Natural Resources (DNR), following review by the <br />Metropolitan Council and DNR. The procedures specified by statute, rule, and the Executive Order <br />standards for the review of proposed pl~ amendments within 45 days of receipt from the Metropolitan <br />Council to determine whether the plans are consistent with the provisions of the order of designation for <br />the Mississippi River Critical Area Corridor have been complied with by the Department. <br /> <br />Pursuant to MN Statutes, section 116G.I0,MN Rules, part 4410.9500, and section E. of Executive Order <br />79-19 Standards and Guidelines, it is hereby ordered that the portions of the proposed City of Ramsey <br />Comprehensive Plan - Mississippi River Critical Area Corridor/MNRRA Plan which affect lands within <br />the Critical Area/MNRRA Corridor, as of March 14,2001, be conditionally approved contingent on: <br /> <br />(1) As noted in previous DNR comments, for those sites developed through a planned cluster <br />development, the 50% of the site preserved as permanent open space shall first permanently preserve <br />the woods,' scenic views, ecological functions, and other features of the natural environment within <br />the planned cluster development site. In addition to the policies to minimize streets and <br />infrastructure, the planned cluster development shall include implementation of low-impact <br />stormwater management practices that focus on on-site infiltration and site design to minimize runoff <br />and mitigate any increased density and impervious surfaces.
