In accordance with Executive Order 79-19, local <br />units of government shall adopt the approved plans within 45 days of DNR's approval and notify DNR. Please <br />send Sandy Fecht of this office notification of the enactment date and effective date of the City's Critical Area <br />Plan following approval within 30 days of such. All future uses and development of these Critical Area lands <br />shall be permitted only in accordance with the City's Plan, Zoning Ordinance (and as amended and approved to <br />comply with Executive Order 79-19), and state Critical Area and Wild and Scenic River laws. <br /> <br />If there are any proposed changes or amendments to this Comprehensive Plan version or the Ordinance in the <br />future, amendments affecting lands within the Critical Area Corridor shall become. effective only after <br />submission to and approval of the Department of Natural ~esources, following an additional review by the <br />Metropolitan Council and DNR. <br /> <br />As required by MN Rules, part 4410.9800 and Executive Order 79-19, section G., the City shall notify the DNR <br />of any appIlcation for a variance or development permit requiring either a public hearing or discretionary action <br />under the City's rules and regulations at least 30 days before taking action on the application. The Department <br />shall also be potified of the final action taken on the application. Various other notifications and DNR <br />approvals are also applicable under the Wild and Scenic Rivers Program, MN Rules, Chapter 6105. Area <br />Hydrologist Tom Hovey, 1200 Warner Road, St Paul, MN 55106 (651-772-7923; fax 651-772-7977) and <br />Sandy Fecht of this office (651-297-2401; fax 651-296-5939) are.your primary contacts for these notifications <br />of applications, hearing dates, and comment deadlines; preliminary review; development approvals; and <br />working with the Department to assure the listed proposed development complies with the Critical Area and <br />Wild and Scenic River goals and ordinance requirements. She is also the primary contact for technical <br />assistance for Mississippi River Corridor ordinance interpretation, Critical Area Plan and Ordinance amendment <br />approvals, and working with you on amendments to your ordinance to comply with the Executive Order, this <br />Plan and approval, voluntary Mississippi National River Recreation Area (MNRRA) policies, and Wild and <br />Scenic River standards. <br /> <br />We thank the City, your staff, and your consultants for their time and effort in working on the Plan to achieve <br />compliance with Executive Order 79-19 and more restrictive voluntary MNRRA policies. Our next step is <br />working together on Mississippi River Corridor ordinance improvements to be consistent with all Executive <br />Order 79-19 and Wild and Scenic River required standards. Sandy Fecht will be contacting you in the future to <br />begin that process. We look forward to continuing our working relationship with you on review of development <br />activities and improvement of the Mississippi River Corridor ordinance to comply with the state requirements <br />and potential voluntary MNRRA policies.
