MN 55101 <br /> <br />Dear Councilmembers: <br /> <br />\.:; you are probably aware, the Voters of Ramsey recently approved a charter amendment which <br />places restrictions on the density of developments that can occur within the area of the city <br />approved tor sewer hookup, otherwise known as the MUSA area. Recent discussions at city <br />I.'ounci) meetings would seem to indicate confusion in regard to the meaning and interpretation of <br />.:ert:.in parts of that amendment. The section I am referring to is contained in 14.2.1, which deals <br />with lot sizes in a proposed development that abuts lots in an existing large-lot development. <br /> <br />FM purposes of my inquiry, I would like you to consider the following assumptions: <br /> <br />I ) The proposed development has not been submitted for any kind of plan approval; <br />therefore, any question in regard to the legality of retroactivity is not applicable. and <br /> <br />2) the section of 14.2.1 as it applies to future developments may be found to be <br />constitutionally acceptable by the appropriate power of the state government. <br /> <br />Based on your reading of Section 14.2, I, I would appreciate your written opinion of what tot <br />"ize~ could be approved for lots in the proposed development that are contiguous to lots in an <br />f''(isting development that are 2.5 acres or larger.
