The county shall provide comments to the Metropolitan Council with regard to the establishmenf of the district within sixty (60) days following receipt of the proposal to establish the district. Subd. 8 MetfQpolitan Council Review. The Metropolitan Council shall review the proposal to establish an Urban Reserve Development District and the ac:c:ompanying Urban Reserve Development Plan and may a.pprove, disapprove or request modification to the ~roposed district or plan. The Metropolitan Council's determination is a grant of authority and shall not be subject to judicial review. . The Metropolitan Council shall approve or disapprove the creation of a district based on the following factors: · A determination that the land area. is within the planned urban reserve area and that the proposed district and plan are otherwise consistent with the metropolitan blueprint. · That the designation of the District and the adoption of the Plan will likely forestall premature large 101 development of the area. · That the uses specified in the Plan reasonably accommodate the need for urban development in the area covered by the Plan - e.g., reasonable compact development patterns. etc. · That the provision of non-local public services and facilities necessitated by the establishment of the distria and the plan are consistent with and can be accommodated by metropolitan system plans and the applicable plans and programs of other govemmentQ1 bodies. · That the plan reasonably and adequately provides for the location, development and installation of public services and facilities in terms of timing, staging and capacity necessitated by the development specified in the Plan. ., · That the development ",ill accommodate and will not impede the provision of non-local public set\1ices in other parts of the local governmental unit. The Metropolitan Council may Condition approval of the establishment of a district on modification of the district area or the Urban Reserve Development Plan. Metropolitan Council approval of the establishment of a District constitutes permanent authorization to allow the local governmental unit to develop the District in accordance with the Plan and to provide metropolitan services and facilities necessary to accomplish that end. Metropolitan Council authorization may be modified only by the submission of a petition by the owners of 75% of the land within a District. NOWLJD 976732.1 4
