The county shall provide comments to the <br />Metropolitan Council with regard to the establishmenf of the district within sixty (60) days <br />following receipt of the proposal to establish the district. <br /> <br />Subd. 8 MetfQpolitan Council Review. The Metropolitan Council shall review the <br />proposal to establish an Urban Reserve Development District and the ac:c:ompanying Urban <br />Reserve Development Plan and may a.pprove, disapprove or request modification to the ~roposed <br />district or plan. The Metropolitan Council's determination is a grant of authority and shall not be <br />subject to judicial review. . <br /> <br />The Metropolitan Council shall approve or disapprove the creation of a district based on <br />the following factors: <br /> <br />· A determination that the land area. is within the planned urban reserve area <br />and that the proposed district and plan are otherwise consistent with the <br />metropolitan blueprint. <br /> <br />· That the designation of the District and the adoption of the Plan will likely <br />forestall premature large 101 development of the area. <br /> <br />· That the uses specified in the Plan reasonably accommodate the need for <br />urban development in the area covered by the Plan - e.g., reasonable <br />compact development patterns. etc. <br /> <br />· That the provision of non-local public services and facilities necessitated by <br />the establishment of the distria and the plan are consistent with and can be <br />accommodated by metropolitan system plans and the applicable plans and <br />programs of other govemmentQ1 bodies. <br /> <br />· That the plan reasonably and adequately provides for the location, <br />development and installation of public services and facilities in terms of <br />timing, staging and capacity necessitated by the development specified in <br />the Plan. <br /> <br />., <br /> <br />· That the development ",ill accommodate and will not impede the provision <br />of non-local public set\1ices in other parts of the local governmental unit. <br /> <br />The Metropolitan Council may Condition approval of the establishment of a district on <br />modification of the district area or the Urban Reserve Development Plan. <br /> <br />Metropolitan Council approval of the establishment of a District constitutes permanent <br />authorization to allow the local governmental unit to develop the District in accordance with the <br />Plan and to provide metropolitan services and facilities necessary to accomplish that end. <br />Metropolitan Council authorization may be modified only by the submission of a petition by the <br />owners of 75% of the land within a District. <br /> <br />NOWLJD 976732.1 <br /> <br />4 <br />
