In <br />addition to my previous comments on your Critical Area checklist and draft memorandum, I offer the <br />following comments for your use and the City's: <br /> <br />Mississippi River Critical Area Corridor: <br /> <br />Chapter pagel <br />citation <br /> <br />Comment <br /> <br />1 <br /> <br />~ 1, Sentence 2. Change the following: "In 1976 the stretch of the Mississippi River <br />from Ramsey and Dayton to just south of Hastings was designated a critical area ~ <br />Governor Anderson, continued as a critical area aRd in 1979 through Executive Order 79- <br />19 by Governor Quie. and the state legislature made permanent that designation through <br />E}{eeutive Order 79 19 by the Metropolitan Council in 1979." <br /> <br />1 <br /> <br />Last ~, Sentence 2. Change: "These plans were created by local units of government and <br />reviewed by regional and state government agencies to ensure consistency with state <br />laws." <br /> <br />3 <br /> <br />~ 1, Sentence 4. This statement probably goes too far in asserting that the plan meets the <br />objectives of the Shoreland Management Act and Floodplain Management Act; these <br />references should be omitted. This plan would need to be expanded in many ways to <br />accurately do that. However it is not necessary to do so in the Critical Area Plan. At the <br />same time, the Mississippi River and adjacent shoreland area has not been subject to the <br />City's current Shoreland Management ordinance provisions in Sec. 9.21.04. And since no <br />other protected waters are within the Critical Area Corridor, meeting the Shoreland <br />Management Act for the Critical Area Plan is moot. Is the City suggesting that they do <br />want to add the Mississippi River to the Shoreland Overlay District and require <br />landowners to comply with those Shoreland provisions that will be more restrictive than <br />the required Critical Area Overlay District and the Floodplain Overlay District? We can <br />assist in writing the ordinance to do so; however, the City should weigh the benefits of <br />doing so, with the implications for implementation and enforcement. <br />
