<br />Council give some consideration to possible findings, based on the criteria listed above, and <br />direct staff to draft findings for Council action at the next meeting. <br /> <br />Councilmember Cook stated he thought this was one of the best proposals for the cluster <br />subdivisions. One of the things the Council is looking at is the preservation of open space; this <br />subdivision will leave everything that is not being built at this time as open space, and it meets <br />with the greenway area that is mapped to go right behind this. Early in the process they <br />discussed getting an access here and it was not able to be negotiated. He feels this developer <br />worked within the best reasonable way he could under the development that was offered at that <br />time. Mr. Tallman should have been in under the moratorium, but due to the problem of getting <br />the acreage for a second access it fumbled this around. He really wanted this project to go <br />forward and now that they have a second access they should look closely at this. <br /> <br />Community Development Director Trudgeon advised if this exception is granted an entire new <br />subdivision process would be required, including the land that has been acquired and how it <br />would be developed. <br /> <br />Mayor Gamec inquired whether there should be a letter of understanding regarding the <br />acquisition of the adjacent property. <br /> <br />Community Development Director Trudgeon replied there are copies of the purchase agreement <br />on file. <br /> <br />Councilmember Jeffrey questioned if granting the exception would negate the discussion and <br />work that has taken place regarding the management of community septic systems, and whether <br />a precedent would be set. <br /> <br />Community Development Director Trudgeon replied he believes staff is learning more about <br />what needs to be required; however, he understands that Council would like a more thorough <br />understanding regarding the community septic issue. <br /> <br />Councilmember Strommen stated she understands the timing has not been fortunate from Mr. <br />Tallman's standpoint, and had the second access been in place they might have gone forward <br />with this project. But now they are in a different place because of the moratorium, and they need <br />to consider the conditions to define the hardship. The issue she has is that someone else could <br />come forward with what looks like a great design, but the Council still does not have their arms <br />around how they want to address each of the issues in an ordinance, and she does not know why <br />they would differentiate this application from any other one that was to come in. <br /> <br />Mayor Gamec commented the Council previously agreed basically with the concept and design <br />of this subdivision, and the issue was that the developer should acquire the land for another <br />access. <br /> <br />Councilmember Cook stated the Council looked at this project for almost a year with the long <br />cul-de-sac being okay, and when they denied another project with a long cul-de-sac they denied <br />this project as well. <br /> <br />City Council!
