<br />Community Development Director Frolik stated the City did give a courtesy mailing to anyone <br />where they were changing the zoning, but they did not believe they were changing the zoning for <br />this parcel. <br /> <br />Commissioner Johnson indicated this is a unique situation where both sides have valid points. <br /> <br />Commissioner Johnson excused himself from the meeting. <br /> <br />Community Development Director Frolik stated the City does have provisions for conditional <br />rezonings and she could research whether that process could help solve this case. <br /> <br />Chairperson Nixt asked if the owner would be amicable to a conditional zoning which would <br />permit an office building or professional building. <br /> <br />Mr. Raudio stated he is concerned that he had a buyer for that type of development who is now <br />gone, and if they have restrictions on the property they many not be able to move it. <br /> <br />Commissioner Brauer suggested they take no action tonight and give Mr. Raudio time to find a <br />buyer and bring back a proposal to the Planning Commission for consideration of rezoning. <br /> <br />Chairperson Nixt indicated they had no knowledge that the zoning was a mistake, and when they <br />went through the Comprehensive Plan process they felt medium~density residential was a <br />reasonable use for the property. He stated whether through unfortunate means or not, they did <br />feel it was a reasonable use. He indicated he is trying to provide options here tonight so the <br />Planning Commission does not have to deny the request. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Brauer to close the public hearing at <br />8:30 p.m. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Brauer, Jeffrey, Shepherd, Van <br />Scoy and Watson. Voting No: None. Abstain: Commissioner Johnson. <br /> <br />Commission Input <br /> <br />Community Development Director Frolik indicated if they were to table this until the September <br />16th meeting, Staff could research conditional rezoning and any other options. <br /> <br />Commissioner Watson encouraged Mr. Raudio to look at resurrecting the previous office <br />building proposal. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Jeffrey to continue this discussion to <br />the Special Planning Commission meeting on September 16, 2004. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Jeffrey, Brauer, Shepherd, Van <br />Scoy, and Watson. Voting No: None.
