Broadway Avenue <br />Sauk Rapids, MN 56379 <br /> <br />Rick Foster, Riverside Development <br />19230 Evans Street <br />Elk River, MN 55330 <br /> <br />Re: Request for Rezoning and Comprehensive Plan Amendment <br /> <br />Dear Arthur: <br /> <br />In accordance with Minnesota Statute 15.99, this letter shall serve as official notification that the <br />City hereby invokes a 60-day extension to the 60-day time limit for making a decision on the <br />request for a comprehensive plan amendment and a rezoning of Outlot E, River's Bend 3rd <br />Addition. We find it necessary to implement this extension as I have received no direction from <br />you as to how you wish to proceed since the Planning Commission discussion in September. <br /> <br />At the September Planning Commission meeting, they adjourned the public hearing for the <br />comprehensive plan amendment and tabled any further action. They continued the rezoning <br />public hearing to the special Planning meeting scheduled for September 16, along with the <br />pending request for a comprehensive plan amendment. You were not prepared to go forward at <br />the September 16 meeting so the Planning Commission continued your cases to the October <br />Planning Commission meeting. At the October meeting, I reported that you had not made a <br />decision as to how you want to proceed and were exploring your options. The Commission <br />continued your cases to the November Planning Commission meeting. My plan is to have the <br />Planning Commission adjourn the rezoning public hearing at the November 4th meeting and take <br />no action on either the request for a comprehensive plan amendment or the request for rezoning. <br />When you have a course of action in mind, we can publish a new public hearing if necessary. <br />This 60 day extension will give the City until January 1, 2005 to take formal action on the <br />requests for a comprehensive plan amendment and a rezoning. <br /> <br />If you have any questions or need additional information, please don't hesitate to call me. Thank <br />you for your cooperation in this process.
