purposes of the stormwater utility is to set up a fund to rectify these types of situations; they need
to be prioritized and included in the CIP to be addressed.

Councilmember Cook asked if this site plan will rectify the ponding situation on this site and
qualify this property for credits towards the stormwater assessment.

City Engineer Jankowski replied the owner must make an application and it will be reviewed.
He believes up to a 50% credit can be obtained if the ponding on the property can handle this
runoff.

Councilmember Elvig asked if there is language included in the City Staff Review Letter that
will require the road going around this property to be maintained in the winter so that it is
accessible to the Fire Department.

Community Development Director Trudgeon replied Chief Kapler and Fire Marshal Streich have
been addressing fire safety on the site. Staff can look at ways to tie the requirement for the road
maintenance into this approval. The fire suppression on this site is for the new building, not
necessarily for the rest of the facility. This issue has been discussed for a long time. There are
wells on the site that could serve for fire suppression; the owner is working on this issue with
Fire Department staff at this time. He will verify that Fire Department staff has addressed the
issue of the road maintenance.

Motion by Councilmember Elvig, seconded by Councilmember Jeffrey, to approve the site plan
for the addition of a warehouse at Green Valley Greenhouse, contingent upon compliance with
the City Staff Review Letter dated August 31, 2006, except that the requirement for curbing the
new driveway extension be waived.

Motion carried.
