-254— <br />Councilmember <br />introduced the following resolution and moved for its adoption: <br />RESOLUTION #06 -09- <br />RESOLUTION ADOPTING FINDINGS OF FACT # TO REZONE CERTAIN <br />PROPERTY FROM R -1 SINGLE FAMILY RESIDENTIAL TO PLANNED UNIT <br />DEVELOPMENT <br />WHEREAS, the City received an application to rezone certain property in accordance <br />with Section 9.03.03 (Zoning Amendments) and 9.20.31 (Planned Unit Development) of the <br />Ramsey City Code. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That Skyline Partners, LLC, hereinafter referred to as "Applicant," has properly applied to <br />rezone certain property from R -1 Single Family Residential to Planned Unit Development <br />(PUD). <br />2. That the Planning Commission conducted a public hearing pursuant to Section 9.03.03 of <br />the City Code on July 10, 2006 and said public hearing was properly advertised, and the <br />minutes of said public hearing are hereby incorporated by reference. <br />3. That the property proposed to be rezoned is legally described as follows: <br />That part of the north half of the Southeast Quarter of Section 23, Township 32, Range <br />25, Anoka County, Minnesota, described as follows: Commencing at a point on the west <br />line thereof distant 523.00 feet south from the northwest corner thereof; thence south <br />along the west line thereof a distance of 209.00 feet; thence east and parallel with the <br />north line thereof a distance of 1100.32 feet to its intersection with the centerline of <br />County State Aid Highway No. 5 (Nowthen Road) as the same is now laid out and <br />traveled; thence northwesterly along said centerline a distance of 239.81 feet; thence west <br />and parallel with the north line thereof a distance of 981.47 feet to the point of <br />commencement. <br />Subject to an easement for road purposes over the northeasterly 33 feet thereof as <br />measured at right angles to said centerline, according to the United States Government <br />Survey thereof. <br />Subject also to easements, restrictions and reservations of record, if any. <br />Also <br />
