That part of the north half of the Southeast Quarter of Section 23, Township 32, Range <br />25, Anoka County, Minnesota, described as follows: Commencing at a point on the west <br />line thereof distant 285.00 feet south from the northwest corner thereof; thence south <br />along the west line thereof a distance of 238.00 feet; thence east and parallel with the <br />north line thereof a distance of 981.47 feet to its intersection with the centerline of <br />County State Aid Highway No. 5 (Nowthen Road) as the same is now laid out and <br />traveled; thence northwesterly along said centerline a distance of 273.08 feet; thence west <br />and parallel with the north line thereof a distance of 846.13 feet to the point of <br />commencement: <br />Subject to an easement for road purposes over the northeasterly 33 feet thereof as <br />measured at right angles to said centerline, according to the United States Government <br />Survey thereof. <br />Subject also to easements, restrictions and reservations of record, if any. <br />Also <br />Lot 3, Block 1, Haubrich Addition <br />4 That the total area of the property to be rezoned is 17 acres in size. <br />5. That the proposed rezoning is located within the Metropolitan Urban Service Area (MUSA) <br />boundary. <br />6. That the Subject Property is currently zoned R -1 Single Family Residential and the <br />surrounding properties are zoned R -1 Single Family Residential MUSA, Public /Quasi <br />Public, and R -2 Medium Density. <br />7. That the development will include single -unit, detached townhomes and attached <br />townhomes. <br />8. That the development is proposing to deviate from City Ordinances in the following <br />manner; mix of housing types and inclusion of housing types not in City Code. <br />That the preliminary plat is proposing 50% private open space in addition to the 6 acre <br />wetland and 36% common usable open space as part of the development, <br />10. That the proposed development will/will not provide high quality design. <br />11. That the proposed development, if revised as requested, will not be compatible with <br />surrounding land uses. <br />12.
