Board Member LaDue introduced the following resolution and moved for its adoption: <br /> RESOLUTION #97-10-301 <br /> A RESOLUTION ADOPTING FINDINGS OF FACT #0444 RELATING TO A REQUEST <br /> FOR A VARIAN CE TO THE HEIGHT RESTRICTIONS IN THE INDUSTRIAL <br /> DISTRICT <br /> WHEREAS, Northern Airgas, Inc., hereinafter referred to as "Applicant", has properly <br /> applied for a Board of Adjustment variance from structure height restrictions to develop an office <br /> and manufacturing facility on the property legally described as follows: <br /> Outlot A, Business Park 95 4th Addition, Anoka County, Minnesota. <br /> (the "Subject Property") <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br /> CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br /> 1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant <br /> to Section 9.03.05 of the Ramsey City Code on October 21, 1997 and that said public hearing <br /> was properly advertised and that the minutes of said public hearing are hereby incorporated <br /> as a part of these findings by reference. <br /> 2. That the subject property is zoned Industrial and is approximately 8 acres in size. <br /> 3. That the Industrial District restricts structure heights to 35 feet. <br /> 4. That the surrounding property is zoned Industrial. <br /> 5. That the Applicant is proposing to develop an office and warehouse facility and the <br /> warehouse portion of the structure measures 42'6" from grade. <br /> 6. That the 35 foot height restriction is based on the reach capabilities of fire suppression <br /> equipment in the City's fire department. <br /> 7. That the Fire Chief has stated that adequate fire suppression can be extended to the warehouse <br /> portion of the structure from rooftops adjacent to the warehouse section. <br /> 8. That only variances to height restrictions on accessory structures in the single family <br /> residential districts have been granted in the past. <br /> 9. That the special conditions causing the undue hardship,restrictions based on fire suppression <br /> reach capabilities do not result from the actions of the Applicant. <br />
