Coordinator Anderson stated the City has been invoiced and paid out $28,000. However,
Mr. Ron Peterson is stating that the contract limit of $33,000 has been exhausted.
Coordinator Anderson stated that at this point, Staff looks at it as still having
approximately $1,500.00 in the budget. He stated it still is a worthwhile project that is
necessary to work with as a tool for the Wetland Buffer Ordinance.

Chairperson McDilda entertained a motion, stating that whatever resolve Staff comes up
with Mr. Ron Peterson and Westwood Professional Services; that Staff puts together a
proposal for the City Council; and the EPB endorses it. He stated he didn't think it was
necessary for the entire EPB to get involved in the negotiation.

Board Member Bentz expressed his concern that Mr. Ron Peterson is an attorney.

Board Member Max stated that the City has their own attorney on staff as well.

Chairperson McDilda stated that the EPB is financially responsible but also
environmentally responsible.

Coordinator Anderson stated that this expenditure was not part of the 2006 general
budget, and there was a reserve of dollars for expenditures specifically related to
environmental services as a pool of money that was part of the settlement from the
Landfill Tipping Fee Fund. He noted that this fund does not get replenished all the time,
but it is one positive way to look at this.

Board Member Max suggested an amendment to the proposed motion that Mr. Ron
Peterson personally sits in at the presentation to the City Council to offer his explanation.

Board Member Bentz asked if the City had done prior work with Peterson
Environmental.

Coordinator Anderson stated that the City has done a lot of work with Hoisington
Koegler Group Inc., and they brought Peterson Environmental with them to other
projects. He noted that Peterson Environmental has done a lot of good work and came to
the City of Ramsey with a good reputation. He stated that the work they have done so far
with the Wetland Study is excellent, however, the escalating costs are a negative factor.

Board Member Bentz asked if after the merger, the City might exercise more caution in
asking for future services from Westwood Professional Services.

Coordinator Anderson stated that the person who made the original proposal is no long
with Westwood Professional Services. Several of the original people involved are no
longer with the firm.

Environmental Policy Board / September 11, 2006
Page 5 of 13
